LL97 Compliance for Article 321 Buildings
Local Law 97 (LL97) establishes carbon emissions limits on New York City buildings over 25,000 gross square feet. While affordable or rent-regulated housing and houses of worship are not exempt from this rule, they may qualify for alternative compliance pathways that modify or defer emissions penalties for the 2024-2029 period.

What you need to know about Article 321
- Buildings with more than 35% of units subject to rent regulation, and/or
- Housing Development Fund Cooperatives (HDFCs) or co-ops, and/or
- Buildings with at least one unit participating in a federal project-based assistance housing program (e.g., Section 8, Section 202, Section 811, CoC)
Buildings pursuing the Prescriptive Pathway must implement all applicable measures from the following list of Prescriptive Energy Conservation Measures (PECMs). This list includes measures such as adjusting temperature set points for heat and hot water, repairing heating system leaks, maintaining heating systems, installing individual temperature controls or insulated radiator enclosures, insulating heating and hot water pipes, and installing heating system sensors and boiler controls.
The extension deadline to submit documentation through the Department of Building’s (DOB’s) “Mediated Resolution” penalty-mitigation process was December 31, 2025.
