LL97 Compliance for Article 321 Buildings

Local Law 97 (LL97) establishes carbon emissions limits on New York City buildings over 25,000 gross square feet. While affordable or rent-regulated housing and houses of worship are not exempt from this rule, they may qualify for alternative compliance pathways that modify or defer emissions penalties for the 2024-2029 period.

Eligible buildings may choose from two pathways

Prescriptive Pathway

Implement all applicable Prescriptive Energy Conservation Measures (PECMs) and submit a one-time report certified by a qualified retro-commissioning ("RCx") agent by May 1, 2025.

Performance-based Pathway

Performance-based Pathway: Demonstrate the building’s 2024 emissions already meet the 2030 emissions limits and submit a one-time report certified by a registered design professional (RDP) by May 1, 2025.
